Privacy Policy


1. Objective & Scope of Policy

Century 21 First Canadian Corp. is committed to respecting your privacy and has prepared this Policy to inform you of our policy and practices concerning the collection, use and disclosure of Personal Information.

This Policy governs Personal Information collected from and about (i) individuals who are or may become Clients of Century 21 First Canadian Corp. and (ii) individuals or organizations with whom Century 21 First Canadian Corp. works with.

Using contractual or other arrangements, Century 21 First Canadian Corp. shall ensure that agents, contractors or third party service providers, who may receive Personal Information in the course of providing services to Century 21 First Canadian Corp. as part of our delivery of real estate services, protect that Personal Information in a manner consistent with the principles articulated in this Policy.

This Policy does not cover aggregated data from which the identity of an individual cannot be determined. Century 21 First Canadian Corp. retains the right to use aggregated data in any way that it determines appropriate.

2. The Collection, Use & Disclosure of Personal Information

For the purposes of this Policy:

Client means an individual who may or has purchased or sold real estate or services to buy or purchase real estate;

"Personal Information" means any information, recorded in any form, about an identified individual, or an individual whose identity may be inferred or determined from such information.

Your provision of Personal Information to Century 21 First Canadian Corp. means that you agree and consent that we may collect, use and disclose your Personal Information in accordance with this Privacy Policy. If you do not agree with these terms, you are requested not to provide any Personal Information to Century 21 First Canadian Corp. or a Broker or Sales Representative working with Century 21 First Canadian Corp. Unfortunately, certain services can only be offered if you provide Personal Information and consequently, if you choose not provide us with any required Personal Information, Century 21 First Canadian Corp. may not be able to offer you those services.

This office only collects personal information necessary to effectively market and sell the property of sellers; to locate, assess and qualify properties for buyers and to otherwise provide professional and competent real estate services to clients.

Century 21 First Canadian Corp.’s Brokers or sales representatives may use personal information for commission management purposes (e.g. commission financing, commission dispute resolution).

Century 21 First Canadian Corp.’s use of Personal Information is limited to these purposes. Century 21 First Canadian Corp. does not sell, trade, barter or exchange for consideration any Personal Information it has obtained. Unless permitted by law, no personal information is collected about an individual without first obtaining the consent of the individual to the collection, use and dissemination of that information.

Personal information will be collected, to the extent possible, directly from the individual concerned.

Century 21 First Canadian Corp. does not knowingly collect Personal Information from anyone under the age of 18, especially children under 13, and does not use such information if Century 21 First Canadian Corp. discovers that it is has been provided by a minor.

Personal Information may also be transferred to another company in the event of a change of ownership of all or part of Century 21 First Canadian Corp.

Century 21 First Canadian Corp. may disclose Personal Information of Clients to organizations that perform services on its behalf. This will only be done if such organizations agree to use such information solely for the purposes of providing services to Century 21 First Canadian Corp. and, with respect to that information, to act in a manner consistent with this Policy.

Please note that there are circumstances where the use and/or disclosure of Personal Information may be justified or permitted or where Century 21 First Canadian Corp. is obliged to disclose information without consent. Such circumstances may include:

Where required by law or by order or requirement of a court, administrative agency or other governmental tribunal;
Where Century 21 First Canadian Corp. believes, upon reasonable grounds, that it is necessary to protect the rights, privacy, safety or property of an identifiable person or group;
Where it is necessary to establish or collect monies owning to Century 21 First Canadian Corp.
Where it is necessary to permit Century 21 First Canadian Corp. to pursue available remedies or limit any damages that Century 21 First Canadian Corp. may sustain; or
Where the information is public.

Where obliged or permitted to disclose information without consent, Century 21 First Canadian Corp. will not disclose more information than is required.

3. Accuracy

Century 21 First Canadian Corp. endeavours to ensure that any Personal Information provided by Clients and in its possession is as accurate, current and complete as necessary for the purposes for which Century 21 First Canadian Corp. uses that data. Information contained in files that have been closed is not actively updated or maintained.

4. Retention

Century 21 First Canadian Corp. retains Personal Information as long as Century 21 First Canadian Corp. believes it is necessary to fulfil the purpose for which it was collected and Firm legal or business requirements.

5. Security

Century 21 First Canadian Corp. endeavours to maintain adequate physical, procedural and technical security with respect to its offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of Personal Information.

6. Protecting Information

Century 21 First Canadian Corp. further protects Personal Information by restricting access to it to those Employees and Contractors that the management of Century 21 First Canadian Corp. has determined need to know that information in order that Century 21 First Canadian Corp. may provide services to Clients.

7. Access to Personal information

Century 21 First Canadian Corp. permits access to and review of Personal Information held by Century 21 First Canadian Corp. about an individual by the individual concerned.

If an individual believes any Personal Information concerning that individual is not correct, that person may request an amendment of that information by sending a request to the person indicated in Section 1 of this Policy. Century 21 First Canadian Corp. reserves the right not to change any Personal Information but will append any alternative text the individual concerned believes appropriate. Where not required to be retained by the Firm, an individual may also request that Century 21 First Canadian Corp. delete an individual’s Personal Information from Century 21 First Canadian Corp. system and records. However, due to constraints of computer technology and the fact that Century 21 First Canadian Corp. backs up its systems, Personal Information may continue to reside in Century 21 First Canadian Corp.s systems after deletion. Individuals, therefore, should not expect that their Personal Information would be completely removed from Century 21 First Canadian Corp. systems in response to an accepted request for deletion.

Century 21 First Canadian Corp. reserves the right to decline access to Personal Information where the information requested:

a) Would disclose the Personal Information of another individual or of a deceased individual;

b) Would disclose business confidential information that may harm Century 21 First Canadian Corp. or the competitive position of a third party;

c) Is subject to solicitor-client or litigation privilege;

d) Could reasonably result in: (i) serious harm to the treatment or recovery of the individual concerned; (ii) serious emotional harm to the individual or another individual; or (iii) serious bodily harm to another individual;

e) May harm, or interfere with, law enforcement activities and other investigative or regulatory functions of a body authorized by statute to perform such functions;
f) Is not readily retrievable and the burden or cost of providing would be disproportionate to the nature or value of the information; or

g) Does not exist, is not held, or cannot be found by Century 21 First Canadian Corp.

Where information will not or cannot be disclosed, the individual making the request will be provided with the reasons for non-disclosure.

Where information will be disclosed, Century 21 First Canadian Corp. will endeavor to provide the information in question within a reasonable time and no later than 30 days following the request.

Century 21 First Canadian Corp. will not respond to repetitious or vexatious requests for access. In determining whether a request is repetitious or vexatious, it will consider such factors as the frequency with which information is amended, the purpose for which the information is used, and the nature of the information.

To guard against fraudulent requests for access, Century 21 First Canadian Corp. will require sufficient information to allow it to confirm the identity of the person making the request before granting access or making corrections.

8. Amendment of Practices and This Policy

This statement is in effect as of January 1, 2004. Century 21 First Canadian Corp. will from time to time review and revise its privacy practices and this Policy. In the event of any amendment, an appropriate notice will be communicated to Clients and others in an appropriate manner.

 

Specific Website Privacy Policy

At Century 21, it is our intention to give you as much control as possible over your privacy in regard to your Information and the use we make of it in the course of your visit to and any interaction with our website.

  1. Types of Information

    We receive two types of information from Customers who visit our website: (1) data that Customers provide through registration or other communication on our website; and (2) data Century 21 gathers through aggregated tracking procedures, such as tallying the number of page views throughout our website over a given period of time. This Information enables us to tailor our website content to better meet the needs of our Customers. However, we assure you that Century 21 will not disclose your personal Information to third parties without first obtaining your consent, except in conjunction with your participation in any online transaction Century 21 may offer from time to time.

  2. How Does Century 21 Collect Information?

    (a) Registration: Information may be collected by specifically requesting it from you on our website. Generally, this occurs when you register at our website or otherwise request information or a service from us. Usually, our website and its necessary service partners collect your Information in order to facilitate the operation of our website and to deliver the services it offers. Our website also uses your Information to inform you of other products or services available from Century 21 and its affiliates.

    (b) Usage tracking:

    (i) Use of IP Addresses: An IP address is a number that is automatically assigned to your computer whenever you're surfing the Internet. Web servers automatically identify your computer by its IP address.

    Century 21 and/or its affiliates collect IP addresses for the purposes of system administration, to report aggregated information to our advertisers, and to audit the use of our website. When Customers request pages from our website, our servers log the requesting Customers' IP addresses. Except where you participate in any online transaction Century 21 may offer from time to time, we normally will not link IP addresses to anything personally identifiable, which means that Customers' sessions will be logged, but Customer identity remains anonymous to us. We can and will use IP addresses to identify a Customer when we feel it is necessary to enforce compliance with our rules or terms of service or to protect our service, website, or any person, or where it is otherwise permitted by law.

    (ii) Use Of Cookies: Cookies are bits of information that a website transfers to an individual's hard drive for record-keeping purposes. Cookies make Web surfing easier for you by saving your preferences while you visit our website. We never save passwords or credit card information in cookies. The use of cookies is an industry standard, and, as such, you'll encounter them at most major websites.

    By showing how and when Customers use our website, cookies help us see which areas are popular and which are not. Many improvements and updates to our website are based on data collected using cookies, such as the total number of visitors and pages viewed in a given period of time. This kind of information is most easily tracked using cookies.

    Century 21 and/or its affiliates have two primary uses for its cookies. First, we use them to specify preferences. For example, Customers can specify keywords across several categories or markets so you don't have to tell us over and over again about the kinds of homes you are interested in obtaining information about. Secondly, we use cookies to track Customer trends and patterns. This helps us to better understand our Customers' needs and to improve areas of Century 21 and/or its affiliates' services that our Customers may find valuable. Sometimes, Information from cookies is attached to messages sent to our Customer Service department. While all of these situations depend on the use of a cookie, you always have the option of disabling the receipt of cookies on your computer by adjusting the cookies setting in you Web browser preferences.

    Most browsers are initially set up to accept cookies. You can reset your Web browser to either refuse all cookies or indicate when a cookie is being sent, with a concurrent option to accept or receive the cookie. However, note that some of the services offered on our website will not function properly or may be considerably slower if you refuse to receive cookies. For example, without cookies, you will not be able to set personalized preferences. You might also encounter difficulties participating in online transactions offered on our website from time to time.

    Occasionally, you may receive cookies from our advertisers. Century 21 and/or its affiliates do not control these cookies. The use of advertising cookies sent by third-party servers is standard in the Internet industry.

  3. What happens when you link to a third party site?

    You should be aware that when you are on our website you could be directed to other sites that are beyond our control. There may, from time to time, be links to other sites from Century 21's and/or its affiliates' webpages that take you outside our service areas. For example, if you "click" on a banner advertisement on a Century 21 webpage, the "click" typically takes you off our website. These other sites may include sites of advertisers, sponsors and partners that may use Century 21's and/or its affiliates' logos as part of a co-branding agreement. These other sites may send their own cookies to Customers, or otherwise collect data or solicit Information.

    Century 21 and its affiliates do not control such sites, and, therefore, are not responsible for their content. Century 21's and/or its affiliates' provision of hyperlinks to these sites does not imply any endorsement of the material on such sites or any association with their operators. Our Privacy Policy does not extend to anything that is inherent in the operation of the Internet and which is beyond the control of Century 21 and its affiliates.

    Please keep in mind that whenever you give out Information online (for example, via message boards or chat lines), that Information can be collected and used by people you don't know. While Century 21 and its affiliates strive to protect their Customers' Information and privacy, we cannot guarantee the security of any Information you disclose online and so you disclose such Information at your own risk.

  4. Is your Information Secure from Others using the Century 21 Website?

    The importance of securing your Information is of the utmost concern to us. We exercise great care in providing secure transmission of your Information from your PC to our servers. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Information, Century 21 and its affiliates cannot promise or warrant the security of any Information you transmit to us, including through the use of our online products or services. Any such transmission is done so at your own risk. Once we receive your transmission, Century 21 uses industry standard efforts to safeguard the confidentiality of your Information, such as firewalls and Secure Socket Layers. However, ironclad security does not yet exist on the Internet.

  5. Your Acceptance of This Policy

    By using our website, you signify your agreement with and acceptance of Century 21's Privacy Policy. If you do not accept this Privacy Policy, please do not use our website in any way. Your continued use of Century 21's and/or its affiliates' sites following the posting of changes to these terms will mean you are deemed to have accepted such changes, regardless of whether Century 21 provides you with additional notice of such changes. Accordingly, you should periodically review this Privacy Policy.
